1. Acceptance of terms
These Terms of Service ("Terms") govern your use of the Alpine Pest Defense website at alpinepestdefense.com and the pest control, rodent control and exclusion services we provide. By using this website, submitting a request through it, or accepting service from us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site or our services.
2. Our services
Alpine Pest Defense (license PR 10164, Mitchell Fleming, Owner) provides residential and commercial pest control, rodent control, wildlife exclusion, and related inspection and prevention services throughout San Diego County, California. Services are performed by licensed personnel in accordance with California law, product labels, and applicable regulations. The scope of work, products used, and pricing for your property will be described in the estimate or service agreement we provide before work begins.
3. Scheduling & access
- Appointments are scheduled within arrival windows, not exact times. We will notify you if a technician is running outside the window.
- You are responsible for providing safe access to the property and treatment areas at the scheduled time, including gate codes, keys, and control of pets.
- If we cannot access the property at the scheduled time, we may reschedule and may charge a trip fee as disclosed in your estimate or service agreement.
4. Pricing, payment & plans
- Prices quoted are based on the information you provide and on what is observed at inspection. If conditions materially differ, we will provide a revised quote before performing additional work.
- Payment is due upon completion of service unless otherwise agreed in writing.
- Recurring protection plans bill on the interval stated in your service agreement and continue until cancelled under Section 5.
- Past-due balances may be subject to late fees and collection costs to the extent permitted by California law.
5. Cancellation
Please give us at least 24 hours' notice to cancel or reschedule an appointment. Recurring plans may be cancelled at any time by calling 619.249.4078 or emailing mitchell@alpinepestdefense.com; cancellation takes effect after any service already scheduled or performed in the current billing period. Cancelling a service plan does not by itself cancel your SMS consent — see Section 8 for how to opt out of text messages.
6. Service guarantee
If covered pests return between scheduled visits under an active recurring plan, we will return and re-treat the affected area at no additional charge. The guarantee applies to the pests and areas identified in your service agreement, requires that recommended preparation and exclusion work has been completed, and does not cover new infestations caused by structural conditions, neighboring properties, or conditions you declined to have addressed.
7. Customer responsibilities
- Complete any preparation steps we give you before treatment (clearing access, covering food, removing pets and people from treated areas for the stated period).
- Follow post-treatment instructions, including re-entry intervals and ventilation guidance.
- Tell us about known hazards, allergies, sensitivities, medical conditions, beehives, aquariums, or protected wildlife on the property before treatment.
- Confirm that you are the owner of the property or are authorized by the owner to approve the services requested.

- Checking the unchecked SMS consent box on the request form at alpinepestdefense.com/#contact and submitting the form;
- Signing a written or electronic service agreement that contains the same SMS consent disclosure; or
- Sending a text message to our business number, which enrolls you for a reply to that conversation.

8.2 How to opt out
You can cancel the SMS service at any time by replying STOP to any message you receive from us. SMS and MMS messaging is not a secure or confidential channel and should not be used for emergencies. For an urgent pest or wildlife emergency, call 619.249.4078. For a medical emergency or exposure, call 911 or Poison Control at 1-800-222-1222.
8.5 Your obligations
- You represent that you are the subscriber to, or the customary user of, the mobile number you provide, and that you are authorized to consent to receive messages at it.
- You agree to notify us promptly if your mobile number changes or is reassigned, by calling or emailing us, so that we do not message the wrong person.
- Standard message and data rates from your carrier apply to messages you send and receive.
8.6 Privacy of messaging data
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as our messaging provider and customer service platform, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
See our Privacy Policy for the full description of how we handle your information.
9. Calls & email
When you provide a phone number, you agree that we may contact you at that number about your requested or existing service, including by voicemail. You may ask us at any time to stop calling and we will add you to our internal do-not-call list. Non-transactional emails include an unsubscribe link; transactional emails such as invoices, receipts and appointment confirmations are part of the service you requested.

11. Disclaimers & liability
Information on this website is provided for general informational purposes and does not constitute a guarantee of specific results. Pest pressure varies with property conditions, weather, neighboring properties and other factors outside our control.
To the maximum extent permitted by California law, Alpine Pest Defense is not liable for indirect, incidental, special, consequential or punitive damages arising from your use of this website or our services. Our total liability for any claim relating to a service is limited to the amount you paid for that service. Nothing in these Terms limits liability that cannot be limited by law, including liability for gross negligence, fraud, or personal injury caused by our negligence.
12. Governing law & disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located in San Diego County, California, and you and Alpine Pest Defense consent to the jurisdiction of those courts.
